Wrongful Death and DUI
In most cases, DUI and Wrongful death litigation is prompted by a party’s act of negligence. Negligence can be defined as a person’s failure to take reasonable precautions that any sensible person is obligated to perform. Failure to abide by these reasonable precautions that result in the injury or death of another individual is what you would call a “breach of duty” and could be considered negligence. In the case of the NFL player Henry Ruggs, Ruggs’ breach of duty was apparent by his decision to step behind the wheel while impaired by drugs or alcohol. This action by Ruggs thus breached his duty to abide by the rules and legislation of operating a motor vehicle. It ultimately resulted in the death of the other driver involved.
